Appeal of Planning Commission Decision

APPELLANT: Hollis Lundeen

APPLICANT: Tidewater Development, LLC

APPEAL: The appellant is appealing the Waldport Planning Commission's Preliminary Plan approval of the proposed 34-lot Vista View Planned Development. The appellant contends that:
 The Findings and Conclusion of the Planning Commission were signed prior to the Planning Commission's approval.
 Relevant Waldport Development Code criteria in Section 16.60.030 C3 & C4 were not addressed. Subsection C3 states that the proposed development will provide amenities or protections at a higher level than would otherwise be provided under conventional land development procedures. Subsection C4 states that the Planning Commission shall seek to determine that the development will not overload streets outside the planned development area, nor will the proposed development create drainage or pollution problems outside the planned area.
 The Preliminary Plan approval was made without relative, current, and accurate traffic data.
 The Preliminary Plan approval is in conflict with the Waldport Yaquina John Point Land Use & Transportation Plan.
 Requirements regarding lot size, lot width, road right-of-way and road width were not observed and required, nor was a site plan provided reflecting the Preliminary Plan approval.
 The Preliminary Plan was approved without verification of ownership regarding the plat that borders the applicant's property.
 Except for the October 23, 2017 meeting, no additional verbal testimony was allowed.

LOCATION: The subject property is located at the south end of Norwood Drive; and further described on Lincoln County Tax Assessor's Map 13-11-19CC as tax lot 120.

REPORTS: Application materials, documents and evidence submitted by or on behalf of the applicant, and applicable criteria may be reviewed or purchased at a reasonable cost at Waldport City Hall, 125 Alsea Highway twenty (20) days prior to the hearing. Any documents or evidence submitted by the applicant after twenty (20) days prior to the hearing constitutes grounds for a continuance of the hearing if any party requests such a continuance. Copies of the staff report for this case may be reviewed without charge or may be purchased at the above address seven (7) days prior to the hearing.

TESTIMONY: Testimony can be submitted in written or oral form. Letters should be sent to City of Waldport, P.O. Box 1120, Waldport, OR 97394, Attn: City Planner. Emails should be sent to Letters and emails must be received by February 22, 2018, 1:00 p.m. Oral testimony will be taken during the course of the public hearing. Failure to raise an issue in a hearing, in person or by letter, or failure to provide sufficient specificity to afford the City Council an opportunity to respond to the issue precludes an appeal to the Land Use Board of Appeals on that issue.
