PLANNING COMMISSION MEETING MINUTES

APRIL 16, 2002


1. ROLL CALL: Chair Balen called the meeting to order at 6:33 p.m. Chair Balen and Commissioners Meatzie, Hauser, Cutter and Uhl were present. Commissioners Milligan and Cvar were absent. A quorum was present. Mr. Thompson introduced Mr. Larry Lewis, who would be replacing him in June.
2. CITIZEN COMMENTS AND CONCERNS: None.
3. COMMISSION COMMENTS AND CONCERNS: Chair Balen noted that the Alsea Highlands Board had taken up the issue of vacation rentals as part of their CC & R review, and progress was being made to restrict them. Another issue for Alsea Highlands was whether they could restrict the size of vehicles on their streets, which were only 30 feet wide with sidewalks. He did not know if the City had any say in the issue. Mr. Thompson suggested that they approach the Infrastructure Committee about the issue. No other concerns were expressed.
4. MINUTES: The Commission considered the minutes from the March 19, 2002 meeting. Commissioner Meatzie moved to accept the minutes as presented. Commissioner Uhl seconded, and the motion carried unanimously on a voice vote.
5. CORRESPONDENCE: None.
6. PUBLIC HEARING: None.
7. OLD BUSINESS: None.
8. NEW BUSINESS:
 A. Workshop Discussion re Transient Rental Policy: Chair Balen noted the materials in the packet included the Yachats ordinance and the proposed Depoe Bay ordinance. Discussion ensued regarding the possible boundaries of a Tourist Accommodation Overlay Zone. Chair Balen stated he felt strongly that transient rentals should not be allowed in a Single-Family Residential zone. Commissioner Cutter asked at what point does a vacation rental become a long-term rental, and what method and by what means can the City verify the existence of a vacation rental. Chair Balen noted that, for the most part, enforcement would complaint-driven. Commissioner Hauser asked the purpose of the review. Chair Balen responded that a policy would give property owners a guideline of what they can and can't do with their property. Mr. Lewis explained that the Depoe Bay proposal was to allow transient rentals in previously disallowed zones. Prior to 1996, transient rentals were allowed in any zone, but by a vote of the people transient rentals were prohibited in all residential zones. Further discussion ensued. Commissioner Cutter worried that this might be adding another level of bureaucracy to an already overloaded system and penalizing only those who are currently complying with the transient room tax requirements. Chair Balen stated that he felt that this would be a means of providing information to those who may be considering starting up a business of transient rentals. Consensus of the Commission was to schedule a workshop for Wednesday, April 24, at 5:30 p.m. to further discuss the issue. Staff will email the City's current Transient Room Tax ordinance to the Commissioners.
 B. Appointment of Replacement Commissioner for Economic Development Committee: Chair Balen noted that he and Commissioner Milligan had originally been appointed, but she had to resign due to other commitments. Following a brief discussion, Commissioner Uhl consented to be the replacement. Staff will notify the Chair of the Economic Development & Downtown Revitalization Committee of the appointment.
 C. Planning Report: Mr. Thompson reviewed his written report.
  Chair Balen welcomed Mr. Lewis and indicated that they looked forward to working with him.
9. ADJOURNMENT: At 7:49 p.m., there being no further business to come before the Planning Commission, Commissioner Meatzie moved to adjourn. Commissioner Hauser seconded, and the motion carried unanimously on a voice vote.

1. CALL TO ORDER AND ROLL CALL: Chair Balen called the meeting to order at 5:37 p.m. Chair Balen and Commissioners Milligan, Uhl and Meatzie answered the roll. Commissioners Hauser, Cutter and Cvar were absent, a quorum was present.
2. CITIZEN COMMENTS AND CONCERNS: None.
3. COMMISSION COMMENTS AND CONCERNS: A brief discussion ensued regarding the proposed improvement to the fence at the old Waldport Motel property.
4. WORKSHOP DISCUSSION: The Commission took up the issue of a transient rental policy. Commissioner Milligan noted the only "booming" business in Waldport is vacation rentals. Commissioner Balen noted the suggestion from the City planner regarding the utilization of the Shorelands Boundary for a possible overlay zone. A lengthy discussion ensued regarding the issue of transient rentals. Chair Balen moved to advise the City Council that, following a discussion at the Planning Commission meeting and a review of the current Waldport statutes and examples from Depoe Bay and Yachats, the Commission felt that the City should enact some rental licensing rules pertaining to transient rentals. The recommendation is that the Council review the Transient Rental License ordinance from the City of Yachats and, if appropriate, that the City incorporate those regulations into the Municipal Code. The Commission also recommended that no "overlay zones" be generated at this time, and if a planned community wishes to restrict transient rentals, those restrictions should be incorporated into their CC & R's. Commissioner Milligan seconded, and the motion carried unanimously on a voice vote.
5. ADJOURNMENT: At 6:22 p.m., there being no further business to come before the Commission, Commissioner Meatzie moved to adjourn. Chair Balen seconded, and the motion carried unanimously on a voice vote.
